Scope

The Terex Privacy Policy (the “Policy”) outlines Terex general practices in connection with the collection of personal data. It applies to Terex operations, divisions and subsidiaries, and to the content of websites owned by Terex.

1. What is personal data?

Personal data refers to information that can be used to learn more about you as a person and your current circumstances (e.g. name, address, telephone number, date of birth or e-mail address). Information that does not allow us to establish a direct connection to you as a person (or only with a disproportionate amount of time and effort), e.g. anonymous information, is not considered personal data.

2. What kind of personal data do we collect and process?

2.1.   Website

We only process and use personal data if it is necessary for operating our website and providing you the services offered on our website.

When you access and use our website, we only collect the personal data that your browser automatically transmits to our server (IP address, date and time of access, name and URL of the retrieved file, website from which access is made, the used browser and, if applicable, the operating system of your computer as well as the name of your access provider). This information is temporarily stored in a so-called log file.

The legal basis for processing the above referenced data is Art. 6 para. 1 GDPR as it is necessary for the provision of our services and protects a legitimate interest of our Company.

2.2.   Contact Information Form

If you complete a contact information form that we offer on one of our Company websites or at a trade show, we will ask for your

  • Name,
  • Your e-mail address and
  • City, Country, Postal Code

You may choose to provide us with this information or decline to do so. However, without these details, we may not be able to fulfill your request. Any other information you wish to provide on the contact form is at your discretion.

This data processing is based on Art. 6 para. 1 b) GDPR.

2.3.   E-mail request

If you send us an e-mail, the personal data you provide will be used only in our correspondence with you. We will ask for your consent before using your personal information for other purposes.  The only processed data category is e-mail address. The legal basis for processing is Art. 6 para. 1 b) GDPR.

We will delete your information as required by law. 

2.4.   Newsletter

On our website you can register for our newsletter using your email address.  You can tell us your name, but you do not have to. If you tell us your name, we will use it to contact you personally.

The legal basis for collecting, storing and processing your personal data is freely given consent according to Art. 6 para. 1 a) GDPR. If you have given your consent, you will receive our newsletter.

Your e-mail address will be deleted in accordance with applicable law.

2.5 Telematics

If a telematics system is included in the sale of our equipment, the telematics system is administered by a third party (“Teleservice Provider”) and collects a range of operational data about the equipment including, but not limited to, usage, performance and reliability. Terex obtains this data for warranty, product improvement, marketing and customer support purposes. Terex may also collect, manage and report data (personal and non-personal) about the equipment including, but not limited to, fuel consumption, up/down times, operation, defects, parts replacement, movement and location. Your subscription to any telematics services, or any telematics optional service you add (“Telematics Services”) shall be for the period, the approved region and at the rate selected by you when subscribing. 

In the event of early cancellation of a subscription, Terex shall be entitled to retain as liquidated damages, and not as a penalty, any fees paid in advance, which reasonably approximate Terex’s actual damages. If you move the Equipment outside the approved region, you may be charged additional fees, or the Telematics Services may be deactivated. Under no circumstances shall Terex be liable for the failure of a Teleservice Provider to perform, or for delays or failures in performance or service interruptions due to circumstances beyond the control of Terex. You understand that Terex and its Teleservice Providers cannot guarantee the security of wireless transmissions and will not be liable for any lack of or breach of security in such wireless transmissions while providing Telematics Services. Terex shall not be liable for lost profits, nor for incidental, indirect or consequential (direct or indirect) damages, even if advised of the possibility thereof.  TEREX’S maximum liability under any theory (including tort, breach of contract or product liability) is limited to the aggregate fees for telematics services that you paid in the calendar year in which the incident causing damage occurred.  

2.6 Terex Financial Services

We collect your personal information so that we can consider any application you make to us, establish and administer the financial product or service provided to you, provide services to you in relation to that product or service, perform administrative functions, conduct customer satisfaction research, improve our products and develop new products, assist you to manager your debts, provide information about you to a guarantor or prospective guarantor, and so that we and our related parties and corporate partners can tell you about other products and services you may be interested in.

In certain circumstances, we may also be required to collect sensitive information about your health, for example when you make an application for assistance with financial hardship caused by illness or injury.  We may collect this information from third parties, for example a doctor or a hospital.

Further, we may collect and use your personal information to comply with legislative and regulatory requirements. We will need to know

  • Your name, date of birth, address and occupation;
  • If we open an Account for you, details of the name of the Account, whether the Account will be held in trust, and details of all signatories to the Account;
  • Details of your beneficial owners including name, address and date of birth.
  • Any other name by which you or any signatories may be known (such as a maiden name); and
  • In the case of a lending facility, enough information to enable us to assess your ability to repay the facility

If you do not provide us with the information we request or authorize us to collect this information from third parties, we may not be able to provide you with the financial products and services that you have requested.

Where possible, we will collect your personal information directly from you.  However, we may also be required to collect personal information (including credit information and credit eligibility information) about you from a third party, for example to verify information provided by you to us or to assist us to contact or locate you.  These parties may include other credit providers or financial institutions, your representatives such as financial advisers or accountants, your insurers, publicly available sources (e.g. telephone directories), brokers, referrers or other intermediaries, our corporate partners or agents, government agencies and credit reporting bodies.

From time to time we may receive information that we have not asked for about you from third parties. We will only keep, use and disclose this information as permitted by law.

 

3.  What do we use your personal data for?

Terex will use personal data only in ways that are compatible with the purposes for which it was collected or subsequently authorized by you. Terex will take reasonable steps to ensure that personal data is relevant to its intended use, accurate, complete and current.

WE DO NOT SELL, RENT, OR SHARE PERSONAL DATA WE COLLECT DIRECTLY FROM YOU OR ABOUT YOU FROM THIRD PARTIES.

We use your personal data solely to provide you with an extensive range of services. Specifically, we may use your personal data to help complete a transaction or order, facilitate communication, deliver and bill for products/services, and to provide ongoing service and support.

If you become a Terex customer, we may use your personal information for marketing purposes related to our services and products, including but not limited to transmitting your personal information to third parties to perform market research such as customer satisfaction surveys and analysis. We only transfer your personal information to third parties outside of the European Union if an adequate level of data protection has been ensured. You can unsubscribe from our marketing research by contacting the Terex Internal Data Protection Officer.

Terex may also share personal information with our service providers and suppliers, for the sole purpose and only to the extent needed to support your business needs. Service providers and suppliers are required to maintain the confidentiality of personal information received from Terex and may not use such information for any purpose other than as originally intended.

The legal basis for collecting, storing and processing your personal data is due to our legitimate interest in ensuring your satisfaction with our products and services.

4.  Where is your personal data transferred?

The Terex Corporation website is hosted in the United States.  If you are accessing this website from the European Union or any other region, please be advised that through your use of this website, your personal data might be transferred to the United States. Terex has implemented the Standard Contractual Clauses (“SCC”) approved by the European Commission for the transfer of personal data outside of the European Economic Area (“EEA”) to the U.S. This applies to data transfers that take place within the Terex group of companies as well as with external service providers.

5.  Anonymous usage data

We do not create personal user profiles. We only store personal data in an anonymous form on our servers. This data allows us to provide a variety of services or will be used for evaluation purposes. Only general information is logged, such as at the time content was retrieved from our pages or which pages are visited most frequently.

6.  Use of cookies

We make use of "cookies" (small text files with configuration information) to determine how often our website is used and the number of users visiting our website.

This usage data does not allow us to draw any conclusions about the user. None of the anonymously collected usage data is combined with your personal data described in Section 2 of this Privacy Statement.

7.  Pardot/Salesforce

Pardot is the maker of a web marketing automation suite. We use Pardot’s suite to gather information about visitors to our website. Personal information is stored in Pardot/Salesforce when our visitors complete forms such as when they subscribe to receive email communications from us. Pardot gathers non-personal information such as IP address, operating system, web browser, and web pages visited.

8.  Social Media Links

We also integrate the following social media sites into our website. The integration takes place via a linked graphic of the respective site. The use of these graphics stored on our own servers prevents the automatic connection to the servers of these networks for their display. Only by clicking on the corresponding graphic will you be forwarded to the service of the respective social network.

Once you click, that network may record information about you and your visit to our site. It cannot be ruled out that such data will be processed in the United States.

Initially, this data includes such things as your IP address, the date and time of your visit, and the page you visited. If you are logged into your user account on that network, however, the network operator might assign the information collected about your visit to our site to your personal account. If you interact by clicking Like, Share, etc., this information can be stored on your personal user account and possibly posted on the respective network. To prevent this, you need to log out of your social media accounts before clicking on the graphic. The various social media networks also offer settings that you can configure accordingly. We maintain an online presence on YouTube to present our company and our services and to communicate with customers/prospects. YouTube is a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, a subsidiary of Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043 USA.

Google and its subsidiary YouTube guarantee that they will follow the EU's data protection regulations when processing data in the United States.

We use YouTube in its advanced privacy mode to show you videos. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in improving the quality of our website. According to YouTube, the advanced privacy mode means that the data specified below will only be transmitted to the YouTube server if you start a video.

Without this mode, a connection to the YouTube server in the USA will be established as soon as you access any of our webpages on which a YouTube video is embedded.

This connection is required in order to be able to display the respective video on our website within your browser. YouTube will record and process at a minimum your IP address, the date and time the video was displayed, as well as the website you visited. In addition, a connection to the DoubleClick advertising network of Google is established.

If you are logged in to YouTube when you access our site, YouTube will assign the connection information to your YouTube account. To prevent this, you must either log out of YouTube before visiting our site or make the appropriate settings in your YouTube account.

The legal basis may also be your consent per Art. 6 para. 1 lit. a GDPR granted to the platform operator. Per Art. 7 para. 3 GDPR, you may revoke this consent with the platform operator at any time with future effect.

When accessing our online presence on the Facebook platform, Facebook Ireland Ltd. as the operator of the platform in the EU will process your data (e.g. personal information, IP address, etc.).

This data of the user is used for statistical information on the use of our company presence on Facebook. Facebook Ireland Ltd. uses this data for market research and advertising purposes as well as for the creation of user profiles. Based on these profiles, Facebook Ireland Ltd. can provide advertising both within and outside of Facebook based on your interests. When you access a page on our website that has Vimeo embedded in it, a connection to Vimeo's servers in the USA is established. For technical reasons, it is necessary for Vimeo to process your IP address. In addition, the date and time of your visit to our website will also be recorded.

9. Website Services

9.1 Google Analytics

Our website uses Google Analytics, a web analysis service provided by Google Inc. ("Google"). 9.2 Google AdWords

9.3  Facebook Pixel Analytics

Our website uses Facebook Pixel.  The Facebook pixel is an analytics tool that allows you to measure the effectiveness of your advertising by understanding the actions people take on your website. The pixel will fire when an individual, referred from Facebook, takes an action on our website. Examples of actions include visiting a page or filling in a form. The pixel receives these actions, also referred to as “events,” which help us analyze best ways to communicate information to followers and customers on Facebook.

The purpose of Facebook Pixel is the promotion of our website by the inclusion of relevant advertising on Facebook about the products and services we offer.

9.4 HotJar Web Analytics

We use Hotjar on our website. This is a web analytics service provided by Hotjar Ltd, Level 2, St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, Europe, hereinafter referred to as "Hotjar".

Hotjar analyzes how our website is used. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the analysis, optimization, and economic operation of our site.

Hotjar allows us to monitor your usage behavior on our website, such as logging and evaluating your mouse movements or mouse clicks. However, your visit to our website will be anonymized. In addition, information about your operating system, your internet browser, incoming or outgoing links, the geographical origin of your access, and the type and resolution of the device you are using are evaluated by Hotjar and processed for statistical purposes. Our website uses Google reCAPTCHA to check and prevent automated servers ("bots") from accessing and interacting with our website. 10. Technical and organizational measures in order to protect personal data stored on our website

Any personal information you entrust to us via our website or in your e-mail correspondence with us is safe. We undertake all reasonable commercial efforts to protect your privacy and your personal information.

We take commercially appropriate technical and organizational security measures to prevent any loss or misuse of the personal data that we store. We review these measures regularly and keep them up to date with advances in technology.

Because of the structure of the Internet it is possible that data protection rules and the safety precautions described above may not be observed by other individuals or institutions outside of our control. Data provided in unencrypted form - even if such is sent by e-mail - may be read by third parties. We have no technical influence over this. 14.  Disclosure about the personal data we store/deletion

We only store the personal details that you provided for the length of time permitted by law.

Upon request, we would be happy to disclose to you which of your personal details we have on file. If, despite our attempts to store correct and up-to-date information, the personal data we have on file is incorrect, we will take steps to correct it immediately. Should you request that we delete the personal data we have stored, once we receive your request, we will delete this data immediately. If it is not possible to delete this information for legal reasons, we will block the data where required by law. However, keep in mind that if your personal data is deleted, we will be unable to continue offering the services described herein unless you request services as a later date. 15. Targeting Minors
